Managing MLO Criminal Background Checks

Institutions can track the status and view the results of Mortgage Loan Originators’ (MLOs) Criminal Background Checks (CBCs) through NMLS.

Institutions are responsible for monitoring the Criminal Background Check (CBC) status of their MLOs and reviewing results once they are available in NMLS. The CBC process ensures that MLOs meet federal requirements for registration under the SAFE Act.

NMLS provides institution users with tools to:
  • Check the status of CBC requests to see whether fingerprints have been taken and processed
  • View the final results of CBCs, including whether records are clear or if a RAP sheet is available
  • Identify and address cases where fingerprints are rejected, illegible, or expired
  • Access CBC results before confirming employment of an MLO
CBC statuses displayed in NMLS include
  • Pending Fingerprints
  • Processing Fingerprints
  • Processing Name Check
  • Closed
  • Expired
.

Results are only available to the institution; NMLS does not provide CBC results directly to individuals.
