NMLS Q2 Reports Released

The NMLS Mortgage Industry Report has been released for the second quarter of 2014. The report contains an analysis of companies, branches, and mortgage loan originators who were licensed or registered through NMLS in order to conduct mortgage activities. Annual CE License Item Being Set August 1, 2014

On August 1, 2014, NMLS will place a license item on the record of every MLO licensee who is not yet compliant for Continuing Education (CE) for 2014. The license item does not impact an MLO's current license status or the ability to originate loans. It is a reminder to complete CE this calendar year in order to be eligible for license renewal for 2015. Every affected MLO and their company will receive an email for every license held for which 2014 CE has not been completed.

CSBS Seeks Comment on Proposed Pre-Licensure Education Expiration Policy

Money Services Business Fact Sheet

NMLS Ombudsman Meeting August 5th

An open meeting with the NMLS Ombudsman will be held on Tuesday, August 5, 2014 from 9:00 - 11:30 am, in conjunction with the AARMR Annual Regulatory Conference in Seattle, Washington. Conference registration is not required to attend the meeting. Suggested agenda items regarding NMLS, state licensing, and/or federal registration will be accepted until Friday, July 25th. Persons submitting discussion items must attend the meeting to present their issue. Submit agenda items by emailing ombudsman@stateregulatoryregistry.org. The meeting will be in-person only; there will be no dial-in available. For more information on the AARMR Annual Regulatory Registry Conference, see the AARMR website.

The major enhancements pertain to: (i) addition of an Industry Dashboard for state-licensed entities; (ii) ability for testing and education investigations to be tracked through NMLS; and (iii) enhancements to the Uniform Licensing Forms and Mortgage Call Report. New NMLS Ombudsman Appointed

Robert S. Niemi, Deputy Superintendent for Consumer Finance with the Ohio Division of Financial Institutions, is the new NMLS Ombudsman. Niemi oversees the non-depository lenders in the state of Ohio. The NMLS Ombudsman provides the financial services industries and other interested parties with a neutral venue to discuss issues or concerns regarding NMLS and state licensing. CSBS has issued a press release regarding the announcement.

Expanded Use of SAFE MLO Test with Uniform State Content

Effective January 1st, four additional state agencies will no longer require mortgage loan originators (MLOs) to take a second state-specific test component when seeking licensure with their state agencies. The agencies are the Nevada Department of Business and Industry, New Mexico Financial Institutions Division, Puerto Rico Office of the Commissioner of Financial Institutions, and U.S. Virgin Islands Division of Banking & Insurance, That brings the total number of state agencies to 39 that have adopted the new National SAFE MLO test. NMLS Ombudsman Meeting February 18

Renewal Period End and Reinstatement

The Renewal Period for 2014 is closed. The Reinstatement Period will be open from January 1st through February 28th.
 
Not all states allow for reinstatement, and others may have an earlier deadline; review the Annual Renewal page to determine reinstatement details and requirements.

System Maintenance December 7th

System Upgrade October 18-21

NMLS will undergo system maintenance on Friday, October 18, starting at 9:00 pm ET. The system will be unavailable until the upgrade is complete, which is expected to be Saturday afternoon. The majority of changes are to accommodate the implementation of regulator log, five-year test expiration policy, and renewal enhancements. Expanded Use of SAFE MLO Test with Uniform State Content

Effective today, five additional state agencies will no longer require mortgage loan originators (MLOs) to take a second state-specific test component when seeking licensure with their state agencies. That brings the total number of state agencies to 35 that have adopted the new National SAFE MLO test. Another two agencies have announced their adoption of the new test effective January 2014. Puerto Rico adds Exempt Non-Profit Company Registrations to NMLS October 1

NMLS is now receiving new application filings for Exempt Non-Profit Company Registrations for Puerto Rico Bureau of Financial Institutions. New applicants are now able to submit these records through NMLS.

NMLS Not Affected by Federal Shutdown

Selection Process for NMLS Call Center Services Completed

The State Regulatory Registry LLC has approved the proposal submitted by Stream Global to provide call center services for NMLS.  SRR is a subsidiary of the Conference of State Bank Supervisors.
 
SRR’s decision to select Stream Global, a Minnesota-based firm, was based on Stream’s demonstration of its expertise in providing top tier customer service to callers as well as sophisticated monitoring metrics.

System Upgrade September 21st

NMLS Release 2013.2.3 will be deployed on Saturday, September 21st starting at 7:00 a.m. ET. The System will be unavailable until the release is complete, which is expected to be before 12:00 p.m. ET. The release will address various Authorized Agent functionality. Both NMLS and NMLS Consumer Access will be unavailable during the deployment.

The state agencies of Connecticut, Delaware, Florida, Hawaii, Idaho, Massachusetts, Missouri, Montana, Nebraska, New York, North Carolina, Puerto Rico, Rhode Island, and Utah DFI will require a new criminal background check as a prerequisite to the 2014 license renewal process for mortgage loan originators.    If an individual’s prints on record in NMLS are more than three years old, the MLO will be required to obtain new fingerprints in order to submit a criminal background request.  Emails have been sent to affected MLOs and company Account Administrators, and information on the criminal background requirements and procedures can be found on the NMLS Resource Center.  Specific state requirements for license renewal can be found on the NMLS Annual Renewal page.

Expanded Use of SAFE MLO Test with Uniform State Content

Effective today, 10 additional state agencies will no longer require mortgage loan originators (MLOs) to take a second state-specific test component when seeking licensure with their state agencies. That brings the total number of state agencies to 30 that have adopted the new National SAFE MLO test.  Another five agencies have announced their adoption of the new test effective October 2013 and January 2014. New NMLS Criminal Background Check Processing Fee Effective July 1, 2013

Reflecting a recent change in the amount charged for Criminal Background Checks by the Federal Bureau of Investigation, the NMLS Processing Fee for Criminal Background Checks will be reduced to $36.25 beginning July 1, 2013.  This new fee will apply to all Criminal Background Checks authorized in NMLS on or after July 1.  Any Criminal Background Checks authorized prior to July 1 will continue to generate a processing fee of $39.

All state-licensed individual mortgage loan originators (MLOs) are required to complete at least 8 hours of NMLS approved continuing education (CE) annually.  A majority of state regulators will prevent the submission of a renewal request if CE has not be completed. New Forms and New Industries

Updated uniform NMLS Licensing Forms for Companies, Branches, and Individuals have been implemented in NMLS. These new forms are the result of an every two year review and update process and include changes that allow state regulators to use NMLS for non-depository financial services industries besides mortgage (see New Industries). Existing NMLS users will need to provide additional information, including disclosure questions, when they make their next filing. For more details, see New Forms. Note: Any pending filing based on the old forms will need to be refreshed and re-attested before it can be submitted.

New NMLS Ombudsman Appointed

NMLS Updating Industry Terms of Use

The NMLS Industry Terms of Use will be updated on April 16, 2012. Changes include the removal of the term “mortgage” from various sections in order to make the NMLS Industry Terms of Use applicable to a broad range of non-depository, financial services industries that state regulators will begin managing on the system. Additionally, the Consumer Financial Protection Bureau (CFPB) is identified as a federal regulatory user of NMLS; and regulatory actions posted by state regulators have been added to the list of data that can be made publicly available (Section 4F). States will Soon Manage Additional Licenses for Non-Depository Industries through NMLS

With the implementation of new NMLS licensing forms in April 2012, NMLS is also being modified for state agencies to license or register entities in a number of non-depository, financial service industries other than mortgage. Reinstatement Period Will End on Wednesday, February 29th

Late CE Reporting Deadline

The deadline for course providers to submit Late CE course completions to NMLS is February 28 at 5pm ET.  Any course completion submitted to NMLS by this deadline will be credit banked that evening so that the MLO’s record will show compliance for CE, and the MLO will be able to apply for reinstatement on February 29.  This deadline is the absolute final deadline to have 2011 CE completed and reported to NMLS.  Any MLO who had a requirement to complete CE in 2011 and who misses this deadline’s, his or her license status will likely be affected.

MCR Reminder

State-licensed companies are reminded that Mortgage Call Report components are due throughout the year. The RMLA component (loan activity data) is submitted after every quarter. Companies can now submit their Q2 RMLA, which is due August 14. The FC component (financial condition) is due 90 days after the company’s fiscal year end. Companies with a fiscal year end in the spring should be aware of the due date of their FC component.

Montana Adds Mortgage Servicer License

Changes include: clarification of the definition of “Applicant Data”; additional language regarding an individual’s granting access to a company; addition of Privacy Act of 1974 Notice; removal of reference to use of Applicant Data for purposes under Section 603(d) of the Fair Credit Reporting Act; addition of references to SAFE Mortgage Loan Originator Test components in Section 8; addition of right of termination or suspension of access to the system for failure to pay any fees required for services under the Agreement. MCR Deficiencies Coming June 16

On June 16 a license deficiency will be placed on state-licensed companies who have not submitted their Q1 Mortgage Call Report. Over 11,000 companies have successfully completed their Q1 MCR in NMLS. Companies that still need to complete their MCR should go to Getting Started: MCR.

HUD Grants Puerto Rico Extension

The U.S. Department of Housing and Urban Development has allowed Puerto Rico mortgage loan originators until December 31, 2011 to fully comply with the licensing provisions of the Safe Acts SAFE Act. Additionally, users may discover that NMLS notifications are being caught in a spam filter. To prevent these notifications from being blocked, users should add NMLS email addresses to their address book or a list of approved senders. NMLS will release system enhancements Saturday, April 30. The system will be unavailable effective 9:00 PM Eastern time on 4/29/2011 until the release is completed on May 01, 2011. The major enhancement for state regulated companies will include the implementation of the Mortgage Call Report, which will allow companies to submit Standard MCR and Expanded MCR reports manually or through an xml file upload. The major enhancements for federally regulated institutions will include the ability to transfer actively registered MLO’s from one federally regulated institution to another federally regulated institution in the event of a merger or acquisition through a NMLS batch upload function.

NMLS Updating Applicant/Licensee Agreement and Privacy Policy

The NMLS Applicant/Licensee Agreement (Industry Terms of Use or Agreement) will be updated on January 31, 2011 to accommodate the anticipated participation of mortgage loan originators to be registered under the final rule promulgated by the Federal Banking Agencies and Farm Credit Administration. Changes to the Agreement or Privacy Policy include: the disclosure that Applicant Data may be checked against other regulatory or governmental databases; the addition that Disclosure Questions may be accessed publicly; clarification that industry users are prohibited from using Applicant Data for purposes under Section 603(d) of the Fair Credit Reporting Act; and the addition that material changes to the Agreement will be emailed to account administrators.   Redline versions of the documents can be found here: Industry Terms of Use and Privacy Policy.

Credit Reporting - November 1st

Every MLO participating in NMLS will receive a system generated credit report license item requiring them to complete the credit report authorization process through NMLS. Two New Reports

Companies now have two new reports available in NMLS to track their mortgage loan originators’ compliance in the areas of Testing and Pre-licensure Education (PE). The reports will provide companies with lists of individuals who are compliant or non-compliant in their Testing (national and state) and PE. The State Regulatory Registry LLC (SRR) Board of Managers has approved policies which will allow state agencies to identify MLOs who have previously completed education or state tests in a manner that satisfies selected SAFE Act requirements. Criminal Background Check Processing

The FBI has announced that the processing of 500,000 fingerprints for the US Census will cause a delay in the return of results of criminal background check requests not related to the Census. The delay will begin April 28th and may extend through May 18th. This will not disrupt a MLO’s ability to request a CBC through NMLS or provide prints through an NMLS approved vendor. MLOs should continue to complete the CBC process in NMLS, but should expect slight delays from the FBI in posting the CBC results to NMLS.

New Company Reports

Several new reports have been developed for companies in NMLS. The Active License Item reports were delivered on March 15, 2010. These reports allow companies to retrieve a list of all outstanding license items set by your Regulator (requirements and deficiencies) for all licenses (company/branch or individual) as of the current date.  Unfortunately, the delivery of certain company reports related to Testing and Education Compliance has been postponed. In support of SAFE Pre-Licensure Education (PE) and Testing Compliance monitoring efforts, reports will be provided on or about April 19, 2010, that will identify Individuals: 1) who have not completed testing and/or education requirements as of the current date or 2) who have completed testing and/or education requirements since the date provided. Similar reports for the monitoring of SAFE Continuing Education (CE) Compliance will be available to companies on or about May 1, 2010. Upon delivery, companies will be able to request these reports under the Reports tab in NMLS.

Test Scheduler Undergoing Maintenance

The NMLS test scheduling system will not be available for SAFE MLO appointment scheduling, rescheduling or cancellation from 12:00 pm (ET) on Friday March, 26th through 8:00 am (ET) on Monday, March 29th. However, the NMLS System will still be available for test enrollment. Individuals who pay for their enrollment during this time will be able to schedule their test immediately after the maintenance is complete.

NMLS Updating Applicant/Licensee Agreement

The NMLS Applicant/Licensee Agreement will be updated on March 31, 2010, modifying Paragraph (F) of Section 4 Applicant Data to add details to the licensee information that may be shared publicly by NMLS. Currently Paragraph (F) provides a non-specific authorization for NMLS to make certain information public. The new language itemizes the specific licensee information that is being made available through NMLS Consumer Access. Notice on Cleanup of Un-submitted Filings

In order to improve system performance, pending filings (not submitted to a state regulator) more than 180 days old for entities that have submitted at least one filing through NMLS to a state agency are being deleted from NMLS on Wednesday, February 24th. The deletion of these un-submitted pending filings will not affect your license, nor any filings created within the last 180 days. Licensees are reminded that, notwithstanding deadlines that might apply within individual states, changes to your licensing information must be reported to state regulators through NMLS within 30 days of occurrence.

NMLS Introduces Criminal Background Check, MU Form Changes

NMLS has been upgraded incorporating federal criminal background check functionality and changes to the national MU Forms approved by regulators this past fall. Starting January 25, 2010, all new mortgage loan originator application filings will require a federal criminal background check to be obtained through NMLS. SRR Issues Responses to Public Comments Received on Background Check Processing in NMLS

When this 30 day comment period ended, SRR had received nearly 200 comments from 110 commenters. The comments were reviewed by NMLS’ Mortgage Licensing Policy Committee. Notice on Cleanup of Unsubmitted Filings

In order to improve system performance, pending filings created prior to January 2009 that were never submitted to a regulator are being deleted from NMLS.  The deletion of these unsubmitted pending filings will not affect your license, nor any filings created after January 1, 2009.  Licensees are reminded that, notwithstanding deadlines that might apply within individual states, changes to your licensing information must be reported to state regulators through NMLS within 30 days of occurrence.  If you have any issues, please contact the NMLS Call Center.

MLO SAFE Compliance Requirement Chart

An overview of SAFE compliance deadlines for mortgage loan originators has been posted on the NMLS Resource Center.  The chart provides information on each agency’s SAFE Requirements.  The chart is not a complete listing of all requirements to obtain and/or maintain a license in a state. MLOs must consult each state’s full requirements.  The chart provides various compliance deadlines to assist MLOs and their companies.  It will be updated regularly. MU Form Changes

Approved changes to the MU Forms will be implemented in January 2010. The changes are in response to comments received during the NMLS Public Comment Period. The MU Forms Working Group reviewed this input and NMLS’ Mortgage Licensing Policy Committee approved these form changes.  The MU Form changes will take effect in NMLS and the Policy Guidebook on January 25, 2010.  For more details see MU Form Changes (PDF, 2MB).

NMLS Policy Guidebook for Licensees released

The NMLS Policy Guidebook for Licensees is a compilation of the policies that were adopted by the Residential Mortgage Regulatory Taskforce (RMRT) in creating the uniform licensing forms and the NMLS. The Policy Guidebook embodies the collective input and decisions of the RMRT since 2005 when the project was initiated. The Policy Guidebook should assist licensees and applicants in understanding the policies related to using NMLS. The Policy Guidebook will be updated as needed to reflect decisions of the RMRT. The Connecticut Department of Banking is adopting the National SAFE MLO Test Component with Uniform State Content, effective October 1, 2014. It is the 45th state agency that will no longer require a second state-specific test component to be taken by mortgage loan originators (MLOs) seeking licensure with its state agency. Connecticut will require one (1) hour of state-specific pre-licensure education effective October 1, 2014 and will require one (1) hour of state-specific continuing education effective January 1, 2015. Ohio Adopts New SAFE MLO Test

The Ohio Division of Financial Institutions is adopting the National SAFE MLO Test Component with Uniform State Content effective September 15, 2014. It is the 43rd state agency that will no longer require a second state-specific test component to be taken by mortgage loan originators (MLOs) seeking licensure with its state agency. Massachusetts Licensees Now Permitted to Use Multiple Trade Names

The Massachusetts Division of Banks has revised its policy on the use of multiple trade names. Entities licensed through NMLS are now permitted to use more than one DBA or trade name under the following parameters: 1) the trade name may not be a separate legal entity from the licensee; and 2) the licensee must consistently use one single trade name when dealing with a consumer over the life of the loan agreement, installment contract, credit application, debt obligation, remittance transaction, cashing or sale of check or money order, etc. All trade names will be visible online in NMLS Consumer Access.
 
If a licensee wishes to conduct business with Massachusetts consumers under more than more trade name or DBA designation, separate license(s) are required for those names. Licensees must obtain approval from the Division to use more than one trade name. Please contact the Division's licensing unit at 617-956-1500, extension 351 for more information and instruction on how to apply. Missouri Announces Company and Branch Participation in NMLS

The Missouri Division of Finance will begin accepting new application and transition requests through NMLS starting June 2, 2014 for the company and branch license/registration types listed below.

Three Additional Agencies Adopt New SAFE MLO Test

Three additional state agencies are adopting the National SAFE MLO Test with Uniform State Content.  The Tennessee Department of Financial Institutions is adopting the test effective July 1, 2013.  The Texas Department of Savings and Mortgage Lending and the Texas Office of Consumer Credit Commissioner have announced an adoption date of October 1, 2013. This will bring to 27 the number of state agencies that will no longer require a separate state-specific test component to be taken by mortgage loan originators (MLOs) seeking licensure with their state agency.  Tennessee and Texas SML will also require new applicants to complete two and three hours, respectively, of state agency specific pre-licensure education (PE).  See Uniform State Test Implementation Information.

The South Carolina State Board of Financial Institutions (SC-BFI) has enacted Mortgage Lending Act Regulations to clarify a number of issues including the definition of certain terms not previously defined as well as actions necessary to comply with the use of unique identifiers, annual reporting and the submission of application information. Two-Factor Renewal (FEDERAL)

Institution users are required to annually renew their two-factor credential subscriptions. The annual subscription fee is $55. These users will receive an email notification when their subscription is 30 days from expiring, and will be reminded each time they log in to NMLS. Federal Registrant Information to be made available through Consumer Access

Following the end of the initial transition period for the registration of federally regulated mortgage loan originators on July 29, 2011, certain information provided by institutions and individual mortgage loan originators will be publicly viewable through NMLS Consumer Access.  A guide explaining what information will be made available through NMLS Consumer Access, how that information will be displayed, and from what sources the information is derived can be found here.  This information is expected to be available beginning August 1, 2011.

Hawaii Approaching Processing Deadline

The U.S. Department of Housing and Urban Development (HUD) has allowed the State of Hawaii until March 31, 2011 to fully comply with the licensing provisions of the federal and Hawaii Safe Acts. For information on the applicability of this decision to Hawaii Mortgage Loan Originator and Mortgage Loan Originator Company license applications, see Hawaii DFI Extension. The Division of Financial Institutions (DFI) of the State of Hawaii is committed to processing all applications filed by December 31, 2010 to meet the HUD’s extended deadline of March 31, 2011. For the individuals and companies who filed an application on or after January 1, 2011, DFI will continue to process the applications in the order received; however, DFI may not be able to complete the processing of these applications by the March 31 deadline.

South Carolina BFI Extension Has Expired

The South Carolina BFI extension allowing applicants, who submitted a filing by November 1, 2010, to conduct business during license processing expired on March 1, 2011. Only licensees who hold an approved license may conduct business in South Carolina under the jurisdiction of SC BFI.

Florida Extends SAFE Deadline

Individuals and businesses holding an active license can continue to work beyond December 31 as long as the application has been filed and all license requirements are completed by March 31, 2011. HUD Approves South Carolina BFI Processing Extension

In response to a request from the South Carolina Board of Financial Institutions, HUD has approved the agency’s request to permit companies, branches, and their originators that filed applications with SC-BFI prior to November 1, 2010 to continue mortgage lending and servicing activity in South Carolina until March 1, 2011. The additional time is necessary for final processing of these pending applications. This extension does not apply to MLOs or companies that are applying to the South Carolina Department of Consumer Affairs.

South Carolina BFI Extends Processing Date

The South Carolina Board of Financial Institutions has extended the license application processing deadline until December 31, 2010. Mortgage lenders (originators and servicers) that file applications and have paid appropriate fees may continue to operate in the state until the extended date. Failure to have completed application packages by December 31, 2010 with all statutory (SAFE and Title 37 Chapter 22) requirements met will restrict your ability to operate beyond that date. Maryland Extends Deadline

The Maryland Commissioner of Financial Regulation has extended the July 31st deadline for Approved Deficient licensees to resolve deficiencies. As part of the state’s NMLS transition, originators who were previously exempt from licensing and applied under interim status by July 31, 2009, were designated "Approved Deficient" and allowed one year to meet certain requirements. To facilitate the transition, the Agency will allow these Approved Deficient licensees until September 30, 2010 rather than July 31, 2010 for completion of all requirements. New Jersey Extends Processing Date

The New Jersey Department of Banking & Insurance announced that all persons and entities that have filed transition applications on or before July 31, 2010 may continue to do business in the state for an additional 90-day period. The Department has issued an Order that pushes the processing completion date for filers back from July 31, 2010 to October 31, 2010. The Order also requires that all such pending transition filers must have satisfied all requirements for licensure no later than September 30, 2010. See NJ Order No. A10-109.

Federal Agencies Publish Final Rule for the Federal Registry

On July 28, 2010, the Office of the Comptroller of the Currency, Board of Governors of the Federal Reserve System, Federal Deposit Insurance Corporation, Office of Thrift Supervision, Farm Credit Administration, and National Credit Union Administration issued final rules requiring residential mortgage loan originators who are employees of federally-regulated institutions to meet the registration requirements of the Secure and Fair Enforcement for Mortgage Licensing Act of 2008 (S.A.F.E. The Florida Office of Financial Regulation announces it will begin accepting all mortgage license applications through NMLS on October 1, 2010. As required by federal and state law, individuals that want to apply for a loan originator license and businesses that want to apply for a mortgage broker or mortgage lender license will be required to submit their application through NMLS starting October 1, 2010.
