NMLS Ombudsman Meeting Agenda

System Maintenance for Test Appointment System January 29

The NMLS Test Appointment System will undergo system maintenance Sunday, January 29 from 8:00 am to 4:00 pm ET. During the upgrade candidates will not be able to schedule, reschedule, or cancel SAFE MLO test appointments. Tests already scheduled for January 29 will not be affected. Candidates will be able to take their test on that day.

NMLS Ombudsman Meeting

An open meeting with the NMLS Ombudsman will be held on Monday, February 6 from 2:00 pm – 5:00pm, prior to the NMLS Annual Conference in Scottsdale, Arizona. Conference registration is not required for attendance at the meeting. Suggested agenda items, regarding either state licensure or federal registration, will be accepted until January 27. For more information, see NMLS Ombudsman. The meeting will be in-person only; there will be no dial-in available.

Renewal Period Ends

The Annual Renewal Period for 2011 has ended. Several states allow licensees who missed the deadline to reinstate their license. See Annual Renewal for more information.

NMLS Hours of Operation

The system will be unavailable on December 25th and January 1st. The system will be operational from 8:00 am to 8:00 pm (ET) on December 26th and January 2nd.

Call Center Hours

The NMLS Call Center will remain open an extra hour (until 8:00 p.m. ET) December 19th through December 30th. The Call Center is closed on Saturdays and Sundays (including December 31st) and will also be closed on Monday, December 26th.

New Forms for April 2012

The NMLS licensing forms (“MU Forms”) have been updated and will be implemented in the system in April 2012. Specifically, the company and branch forms will include a more developed Business Activities section. State Licensing Report for Q3

System Maintenance November 19

System Upgrade October 21-22

NMLS will undergo system maintenance on Friday, October 21, starting at 9:00 pm ET. The system will be unavailable until the upgrade is complete, which is expected to be Saturday afternoon. The majority of changes are related to the Annual Renewal process which opens November 1st. For an overview of these and other changes, see the Release Summary or Full Release Notes.

Annual Renewal Period Begins November 1

The NMLS Annual Renewal Period will begin November 1 and end December 31. Companies and individuals can prepare by making sure the information on their NMLS record is up-to-date. For details about the renewal process, see Annual Renewal. Companies and institutions can also consider signing up for a renewal training workshop to help them prepare for renewal.

MCR Reminder for Q3 (STATE)

State-licensed companies can now submit their Q3 RMLA, which is due November 14. Companies are also reminded that the FC component (financial condition) is due 90 days after the company’s fiscal year end. For more details, see Mortgage Call Report.

Comments on Regulatory Actions

On July 25, 2011, the State Regulatory Registry LLC (SRR) invited public comment on proposed functionality to allow state regulators to post regulatory actions to NMLS and NMLS Consumer Access. Comments received have been posted under Proposals for Comment. The comments are being reviewed and a response will be posted in the next few weeks.

Change to SAFE MLO Test Retake Policy

System Upgrade on July 30

CSBS Seeks Comment on Regulatory Actions

Call Center Hours to be Extended

To help alleviate the expected increase in call volume as the federal registration’s initial transition period deadline of July 29 approaches, the NMLS Call Center will offer extended hours of availability.  During the weeks of July 18-22 and July 25-29, the Call Center will be open from 9:00 am to 8:00 p.m. (Eastern Time). 

MCR Reminder

State-licensed companies are reminded that Mortgage Call Report components are due throughout the year. The RMLA component (loan activity data) is submitted after every quarter. Companies can now submit their Q2 RMLA, which is due August 14. The FC component (financial condition) is due 90 days after the company’s fiscal year end. Companies with a fiscal year end in the spring should be aware of the due date of their FC component.

Montana Adds Mortgage Servicer License

Montana Division of Banking & Financial Institutions is now accepting applications through NMLS for the Mortgage Servicer License. Effective October 1, 2011, any entity desiring to engage in the business of servicing Montana residential mortgage loans must obtain a Servicer License for its main office address and each branch office. NMLS Updating Industry Terms of Use

The NMLS Industry Terms of Use will be updated on August 1, 2011. Changes include: clarification of the definition of “Applicant Data”; additional language regarding an individual’s granting access to a company; addition of Privacy Act of 1974 Notice; removal of reference to use of Applicant Data for purposes under Section 603(d) of the Fair Credit Reporting Act; addition of references to SAFE Mortgage Loan Originator Test components in Section 8; addition of right of termination or suspension of access to the system for failure to pay any fees required for services under the Agreement. A redlined version of the changes to the Agreement can be found at: Industry Terms of Use.

MCR Deficiencies Coming June 16

On June 16 a license deficiency will be placed on state-licensed companies who have not submitted their Q1 Mortgage Call Report. Over 11,000 companies have successfully completed their Q1 MCR in NMLS. Companies that still need to complete their MCR should go to Getting Started: MCR.

HUD Grants Puerto Rico Extension

The U.S. Department of Housing and Urban Development has allowed Puerto Rico mortgage loan originators until December 31, 2011 to fully comply with the licensing provisions of the Safe Acts SAFE Act. For more information on the applicability of this decision to Puerto Rico Mortgage Loan Originator and license applications, contact the Office of the Commissioner of Financial Institutions of Puerto Rico at reglamentacion@ocif.gobierno.pr.

Receiving NMLS Email Notifications

NMLS sends notifications to users when actions or changes occur that affect their records. It is important for users to keep their email address up to date. Additionally, users may discover that NMLS notifications are being caught in a spam filter. To prevent these notifications from being blocked, users should add NMLS email addresses to their address book or a list of approved senders. NMLS system notifications are sent from NMLS_Notifications@NMLSNotifications.com and news, reminders and upcoming functionality details are sent from no-reply@stateregulatoryregistry.org.

NMLS Ombudsman Meeting

Training Webinar: Reviewing FBI Criminal History

System Upgrade This Weekend

NMLS will release system enhancements Saturday, April 30. The system will be unavailable effective 9:00 PM Eastern time on 4/29/2011 until the release is completed on May 01, 2011. The major enhancement for state regulated companies will include the implementation of the Mortgage Call Report, which will allow companies to submit Standard MCR and Expanded MCR reports manually or through an xml file upload. The major enhancements for federally regulated institutions will include the ability to transfer actively registered MLO’s from one federally regulated institution to another federally regulated institution in the event of a merger or acquisition through a NMLS batch upload function.

Mortgage Call Report Training Workshop

Reg Z Notice Added to All SAFE MLO Tests

Changes to Regulation Z: Loan Originator Compensation will go into effect on April 1, 2011.  The Rules of Conduct presented to test candidates will be modified to instruct candidates that questions on the SAFE MLO Test will not reflect the changes to Regulation Z until further notice.  For more information see Testing.

Call Report Update – Final XML Spec, Spreadsheet Samples

As requested, spreadsheet samples of the Standard and Expanded NMLS Mortgage Call Report have been posted. These samples are for planning purposes only and cannot be uploaded into NMLS.

Federal Registry Training Workshops

Reinstatement Period Ends February 28

System Upgrade on January 29

NMLS will undergo maintenance on Saturday, January 29, for the release of system enhancements. The system will be unavailable until the upgrade is complete.  A majority of the changes are for the implementation of the NMLS Federal Registry, which will allow federal-agency regulated institutions to register their mortgage loan originators in NMLS in accordance with the Final Rule published by the Federal Banking Agencies along with the Farm Credit Administration. NMLS Updating Applicant/Licensee Agreement and Privacy Policy

The NMLS Applicant/Licensee Agreement (Industry Terms of Use or Agreement) will be updated on January 31, 2011 to accommodate the anticipated participation of mortgage loan originators to be registered under the final rule promulgated by the Federal Banking Agencies and Farm Credit Administration. Changes to the Agreement or Privacy Policy include: the disclosure that Applicant Data may be checked against other regulatory or governmental databases; the addition that Disclosure Questions may be accessed publicly; clarification that industry users are prohibited from using Applicant Data for purposes under Section 603(d) of the Fair Credit Reporting Act; and the addition that material changes to the Agreement will be emailed to account administrators.   Redline versions of the documents can be found here: Industry Terms of Use and Privacy Policy.

Mortgage Call Report Coming in 2011

In compliance with the SAFE Act, state laws require mortgage licensees to submit mortgage call reports to NMLS. The NMLS Mortgage Call Report is targeted to be available in April 2011. For more information, see the Mortgage Call Report Page and the Response to Public Comments.

NMLS Introduces Credit Report in Release 2010.4

Credit Reporting - November 1st

NMLS will launch functionality on November 1st that enables an individual to authorize a credit report through NMLS. Two New Reports

Companies now have two new reports available in NMLS to track their mortgage loan originators’ compliance in the areas of Testing and Pre-licensure Education (PE). The reports will provide companies with lists of individuals who are compliant or non-compliant in their Testing (national and state) and PE. Individual MLOs must have granted access rights to the company to appear on the lists.

The State Regulatory Registry LLC (SRR) Board of Managers has approved policies which will allow state agencies to identify MLOs who have previously completed education or state tests in a manner that satisfies selected SAFE Act requirements. Criminal Background Check Processing

The FBI has announced that the processing of 500,000 fingerprints for the US Census will cause a delay in the return of results of criminal background check requests not related to the Census. The delay will begin April 28th and may extend through May 18th. This will not disrupt a MLO’s ability to request a CBC through NMLS or provide prints through an NMLS approved vendor. MLOs should continue to complete the CBC process in NMLS, but should expect slight delays from the FBI in posting the CBC results to NMLS.

New Company Reports

Several new reports have been developed for companies in NMLS. The Active License Item reports were delivered on March 15, 2010. These reports allow companies to retrieve a list of all outstanding license items set by your Regulator (requirements and deficiencies) for all licenses (company/branch or individual) as of the current date.  Unfortunately, the delivery of certain company reports related to Testing and Education Compliance has been postponed. In support of SAFE Pre-Licensure Education (PE) and Testing Compliance monitoring efforts, reports will be provided on or about April 19, 2010, that will identify Individuals: 1) who have not completed testing and/or education requirements as of the current date or 2) who have completed testing and/or education requirements since the date provided. Similar reports for the monitoring of SAFE Continuing Education (CE) Compliance will be available to companies on or about May 1, 2010. Upon delivery, companies will be able to request these reports under the Reports tab in NMLS.

Test Scheduler Undergoing Maintenance

The NMLS test scheduling system will not be available for SAFE MLO appointment scheduling, rescheduling or cancellation from 12:00 pm (ET) on Friday March, 26th through 8:00 am (ET) on Monday, March 29th. However, the NMLS System will still be available for test enrollment. Individuals who pay for their enrollment during this time will be able to schedule their test immediately after the maintenance is complete.

NMLS Updating Applicant/Licensee Agreement

The NMLS Applicant/Licensee Agreement will be updated on March 31, 2010, modifying Paragraph (F) of Section 4 Applicant Data to add details to the licensee information that may be shared publicly by NMLS. Currently Paragraph (F) provides a non-specific authorization for NMLS to make certain information public. The new language itemizes the specific licensee information that is being made available through NMLS Consumer Access. Notice on Cleanup of Un-submitted Filings

In order to improve system performance, pending filings (not submitted to a state regulator) more than 180 days old for entities that have submitted at least one filing through NMLS to a state agency are being deleted from NMLS on Wednesday, February 24th. The deletion of these un-submitted pending filings will not affect your license, nor any filings created within the last 180 days. Licensees are reminded that, notwithstanding deadlines that might apply within individual states, changes to your licensing information must be reported to state regulators through NMLS within 30 days of occurrence.

NMLS Introduces Criminal Background Check, MU Form Changes

NMLS has been upgraded incorporating federal criminal background check functionality and changes to the national MU Forms approved by regulators this past fall. Starting January 25, 2010, all new mortgage loan originator application filings will require a federal criminal background check to be obtained through NMLS. SRR Issues Responses to Public Comments Received on Background Check Processing in NMLS

On September 14, 2009, the State Regulatory Registry LLC (SRR) invited public comment on background check processing in NMLS. When this 30 day comment period ended, SRR had received nearly 200 comments from 110 commenters. The comments were reviewed by NMLS’ Mortgage Licensing Policy Committee. MU Form Changes

Approved changes to the MU Forms will be implemented in January 2010. The changes are in response to comments received during the NMLS Public Comment Period. The MU Forms Working Group reviewed this input and NMLS’ Mortgage Licensing Policy Committee approved these form changes.  The MU Form changes will take effect in NMLS and the Policy Guidebook on January 25, 2010.  For more details see MU Form Changes (PDF, 2MB).

The NMLS Policy Guidebook for Licensees is a compilation of the policies that were adopted by the Residential Mortgage Regulatory Taskforce (RMRT) in creating the uniform licensing forms and the NMLS. The Policy Guidebook embodies the collective input and decisions of the RMRT since 2005 when the project was initiated. The Policy Guidebook should assist licensees and applicants in understanding the policies related to using NMLS. The Policy Guidebook will be updated as needed to reflect decisions of the RMRT. Two-Factor Renewal (FEDERAL)

Institution users are required to annually renew their two-factor credential subscriptions. The annual subscription fee is $55. These users will receive an email notification when their subscription is 30 days from expiring, and will be reminded each time they log in to NMLS. For information on renewing your credential subscription, see the Pay Credential Subscription Fees Quick Guide. Note: This applies only to  institution users, not individual MLOs.

Federal Registrant Information to be made available through Consumer Access

Hawaii Approaching Processing Deadline

The U.S. Department of Housing and Urban Development (HUD) has allowed the State of Hawaii until March 31, 2011 to fully comply with the licensing provisions of the federal and Hawaii Safe Acts. For information on the applicability of this decision to Hawaii Mortgage Loan Originator and Mortgage Loan Originator Company license applications, see Hawaii DFI Extension. The Division of Financial Institutions (DFI) of the State of Hawaii is committed to processing all applications filed by December 31, 2010 to meet the HUD’s extended deadline of March 31, 2011. For the individuals and companies who filed an application on or after January 1, 2011, DFI will continue to process the applications in the order received; however, DFI may not be able to complete the processing of these applications by the March 31 deadline.

South Carolina BFI Extension Has Expired

The South Carolina BFI extension allowing applicants, who submitted a filing by November 1, 2010, to conduct business during license processing expired on March 1, 2011. Only licensees who hold an approved license may conduct business in South Carolina under the jurisdiction of SC BFI.

NMLS Begins Federal Registration

Florida Extends SAFE Deadline

All current Florida licensees must file a new license application in NMLS by December 31, 2010. Individuals and businesses holding an active license can continue to work beyond December 31 as long as the application has been filed and all license requirements are completed by March 31, 2011. HUD Approves South Carolina BFI Processing Extension

In response to a request from the South Carolina Board of Financial Institutions, HUD has approved the agency’s request to permit companies, branches, and their originators that filed applications with SC-BFI prior to November 1, 2010 to continue mortgage lending and servicing activity in South Carolina until March 1, 2011. The additional time is necessary for final processing of these pending applications. This extension does not apply to MLOs or companies that are applying to the South Carolina Department of Consumer Affairs.
 

HUD Grants Hawaii Extension

The U.S. Department of Housing and Urban Development has allowed the State of Hawaii until March 31, 2011 to fully comply with the licensing provisions of the federal and Hawaii Safe Acts. South Carolina BFI Extends Processing Date

The South Carolina Board of Financial Institutions has extended the license application processing deadline until December 31, 2010. Mortgage lenders (originators and servicers) that file applications and have paid appropriate fees may continue to operate in the state until the extended date. Failure to have completed application packages by December 31, 2010 with all statutory (SAFE and Title 37 Chapter 22) requirements met will restrict your ability to operate beyond that date. Maryland Extends Deadline

The Maryland Commissioner of Financial Regulation has extended the July 31st deadline for Approved Deficient licensees to resolve deficiencies. As part of the state’s NMLS transition, originators who were previously exempt from licensing and applied under interim status by July 31, 2009, were designated "Approved Deficient" and allowed one year to meet certain requirements. To facilitate the transition, the Agency will allow these Approved Deficient licensees until September 30, 2010 rather than July 31, 2010 for completion of all requirements. New Jersey Extends Processing Date

The New Jersey Department of Banking & Insurance announced that all persons and entities that have filed transition applications on or before July 31, 2010 may continue to do business in the state for an additional 90-day period. The Department has issued an Order that pushes the processing completion date for filers back from July 31, 2010 to October 31, 2010. The Order also requires that all such pending transition filers must have satisfied all requirements for licensure no later than September 30, 2010. See NJ Order No. A10-109.

Federal Agencies Publish Final Rule for the Federal Registry

On July 28, 2010, the Office of the Comptroller of the Currency, Board of Governors of the Federal Reserve System, Federal Deposit Insurance Corporation, Office of Thrift Supervision, Farm Credit Administration, and National Credit Union Administration issued final rules requiring residential mortgage loan originators who are employees of federally-regulated institutions to meet the registration requirements of the Secure and Fair Enforcement for Mortgage Licensing Act of 2008 (S.A.F.E. The Florida Office of Financial Regulation announces it will begin accepting all mortgage license applications through NMLS on October 1, 2010. As required by federal and state law, individuals that want to apply for a loan originator license and businesses that want to apply for a mortgage broker or mortgage lender license will be required to submit their application through NMLS starting October 1, 2010.
